1. Overview
This website is operated by Heron’s Nest Dahlias. Throughout the site, the terms “we,” “us,” and “our” refer to Heron’s Nest Dahlias.
By visiting our site or purchasing any product, you agree to be bound by these Terms and Conditions (“Terms”). These Terms apply to all users, including browsers, customers, vendors, and contributors of content.
Please read these Terms carefully before using our website. By accessing any part of the site or completing a purchase, you acknowledge and agree to be bound by them. If you do not agree to all terms, you may not use our website or services.
We reserve the right to update or modify these Terms at any time by posting changes to this page. Continued use of our website following
any update constitutes acceptance of those changes.
2. Product Availability and Description
All orders are subject to product availability. Because dahlias and other plant materials are agricultural products, weather and environmental factors may affect supply and quality.
If we cannot fulfill an item, we will notify you and issue a refund for that portion of your order.
We make every effort to describe our products accurately and display true-to-life photos. However, natural variation in size, color, and
form is normal and not grounds for refund. We reserve the right to limit
quantities or discontinue products at any time.
3. Shipping, Handling, and Delivery Guarantee
3.1 Shipping Zones and Carriers
We currently ship within the United States only. Our preferred courier is UPS, though USPS may occasionally be used at our discretion.
Please provide a street address for all orders. If a P.O. Box is required, a Heron’s Nest Dahlias customer service representative will contact you to confirm and make delivery arrangements.
3.2 Shipping Seasons
- Tube Orders: Ship as weather allows, typically March through April, depending on your state and growing zone.
- Rooted Cuttings: Pre-Sale Shipments: Generally April and May
- Overstock Shipments: Typically June
- Other Seasonal or Mini-Clump Sales: As announced via our website and email list
3.3 Combined Shipping
If you place multiple orders before your first order ships, we may combine them and refund excess shipping charges. Combined shipping applies only to orders placed under the same customer account, defined as the same email address used at checkout, and of the same product type (tubers with tubers, cuttings with cuttings). Once an order has shipped, it cannot be combined or refunded for shipping
costs.
3.4 Delivery Guarantee
We guarantee your order will arrive in viable condition if the following conditions are met:
- The recipient takes possession of the shipment within six (6) hours of delivery.
- A warranty claim is submitted within twenty-four (24) hours of delivery confirmation.
- The claim includes photographic evidence of the product’s condition on the day of delivery.
For clarity, the “recorded delivery time” means the timestamp provided by the courier at the time the package is marked as delivered. Failure to meet these conditions voids the delivery guarantee.
3.5 True-to-Form Guarantee
We guarantee that each dahlia variety sold by Heron’s Nest Dahlias is true to the named variety (“true to form”) when it blooms in the customer’s garden. If, upon blooming, the flower does not match the variety purchased, you may file a True-to-Form Guarantee claim.
To qualify:
- The claim must include clear photographic evidence of the bloom.
- The guarantee applies only to plants grown from Heron’s Nest Dahlias stock and blooming in the same growing season as the purchase.
3.6 Exclusions
Our guarantees do not cover damage or loss resulting from mishandling, neglect, pest infestation, disease, exposure to extreme temperatures, or improper storage or planting after delivery.
3.7 Warranty and Restitution
Heron’s Nest Dahlias retains the exclusive right to determine the method of restitution for all approved warranty or guarantee claims. Restitution may include replacement, store credit, or refund at our discretion. Shipping charges are non-refundable under all circumstances.
3.8 Lost, Stolen, or Misaddressed Packages
If the courier marks your package as “delivered” but you have not received it, please contact your local UPS or USPS office using the tracking number provided.
Proof of delivery from the courier constitutes fulfillment of our shipping obligation. Lost or stolen packages after delivery confirmation are not covered under our guarantee.
Heron’s Nest Dahlias is not responsible for orders shipped to incorrect addresses entered by the customer at checkout.
Please double-check all shipping information before finalizing your order. Orders shipped to an incorrect address due to customer entry error are not eligible for warranty or refund.
4. Returns, Refunds, and Cancellations
4.1 Order Cancellations
Orders may be canceled or modified within 24 hours of purchase without charge. After 24 hours, cancellations are subject to a 20% restocking fee.
4.2 Refund Requests
All concerns or disputes regarding product quality must be reported to heronsnestdahlias@gmail.com or by text message to (208) 690-9243 within 24 hours of confirmed delivery, accompanied by clear photographs.
If requested, the product must be returned to us before a refund or replacement can be processed.
4.3 Refund Method and Fees
Approved refunds will be processed to the original payment method, less shipping and any applicable restocking fees. Shipping and handling fees are non-refundable.
4.4 Restocking Fees
- Tubers: 20% restocking fee for returned or canceled orders.
- Cuttings: Non-refundable if returned or refused delivery.
5. Pricing, Payment, and Billing
All prices are listed in U.S. dollars and may change without notice. We accept major credit cards and reserve the right to refuse or limit orders at
our discretion.
You agree to provide accurate billing and contact information. Any orders refused, undeliverable, or returned to us due to an incorrect address may incur additional shipping or restocking charges.
6. Privacy and Data Use
Your privacy is important to us. Personal information is used only to process orders or communicate about your purchase. We do not sell or share customer information except as necessary to complete transactions (e.g., with payment processors or shipping carriers).
7. Prohibited Uses
You agree not to use our site or content for unlawful, harmful, or fraudulent purposes, including but not limited to harassment, defamation, data scraping, or transmitting malicious code. We reserve the right to terminate your access for violations of this policy.
8. Right to Refuse Sale
Heron’s Nest Dahlias reserves the right to refuse the sale of products to any customer, for any reason, at any time, at its sole discretion. This right may be exercised to protect the integrity of our business operations, ensure product availability for existing customers, prevent abuse of sales policies, or for any other reason deemed appropriate by Heron’s Nest Dahlias.
9. Disclaimer of Warranties; Limitation of Liability
Our products are living agricultural materials and naturally subject to variation and environmental influence.
Heron’s Nest Dahlias makes no guarantee of specific bloom performance, growth, or longevity. To the fullest extent permitted by law, we disclaim all express or implied warranties and shall not be liable for indirect or consequential damages, including loss of profits, data, or crops.
10. Indemnification
You agree to indemnify and hold harmless Heron’s Nest Dahlias, its owners, employees, and affiliates from any claims, losses, or expenses arising out of your violation of these Terms or misuse of our website or products.
11. Severability
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.
12. Governing Law
These Terms and any disputes shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict-of-law provisions.
13. Entire Agreement and Updates
These Terms constitute the entire agreement between you and Heron’s Nest Dahlias and supersede all prior agreements or understandings, written or oral. We may update these Terms periodically. The version posted on our website at the time of your purchase governs your order.
